Difference between Article 356 and Article 365 of the Indian Constitution

Article 356 and Article 365 are two crucial provisions in the Indian Constitution but they deal with different situations.

Article 356 deals with the "Failure of constitutional machinery in the State" and empowers the President to impose President's rule in a state if the governor submits a report to the President that the governance of the state cannot be carried out according to the Constitution. Under this provision, the President can assume the functions of the state government and declare that the powers of the State Assembly are to be exercised by the Parliament.

On the other hand, Article 365 deals with the "Failure of States to comply with the recommendations of the Union" and states that if any state fails to comply with, or to give effect to, any directions given by the Union government, it shall be lawful for the Union government to declare that the power of the state legislature to make laws on that subject shall be exercisable by the Parliament. In effect, it allows the Union government to take over the law-making power of a state.

In summary, Article 356 deals with the imposition of the President's rule in a state while Article 365 deals with the Union government's power to take over a state's law-making powers.
