Indian Penal Code Section 153 deals with the offense of wantonly giving provocation with intent to cause riot. It states that whoever malignantly or wantonly by doing anything which is illegal, gives provocation to any person intending or knowing it to be likely that such provocation will cause the offense of rioting to be committed, shall, if the offense of rioting be committed in consequence of such provocation, be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both; and if the offense of rioting be not committed, with imprisonment of either description for a term which may extend to six months, or with fine, or with both.

The key elements of this offense are:

  • Malignant or wanton provocation: The provocation must be intentional or reckless.
  • Illegal means: The provocation must be done by illegal means.
  • Intent to cause riot: The accused must have the intention of causing a riot, or must know that the provocation is likely to cause a riot.
  • Riot: The provocation must actually result in a riot.

It is important to note that this offense is different from the offense of rioting itself. Rioting is an offense committed by a group of five or more people who act together in a disorderly manner with the common object of causing or promoting violence or disturbance. Section 153, on the other hand, is committed by a single person who provokes others to riot.

Here are some examples of acts that could be considered to be wanton provocation with intent to cause riot:
